At this point, we don’t see any other recourse but to remove U.S. District Judge Derrick Watson from the bench. If that takes an act of Congress, so be it. Because there comes a point when a judge’s decisions are so far off the constitutional page that his presence in a courtroom turns into a liability for the strength of the republic. And with his latest ruling on the new version of President Trump’s travel ban, Judge Watson has crossed that line. The Hawaiian judge has already been smacked down by the Supreme Court; we’re not sure what else can be done to get the law through his thick, partisan skull.
Just hours before Trump’s new travel restrictions were to go into effect, Judge Watson blocked the ban on Tuesday, saying that it “suffers from precisely the same maladies as its predecessor.”
The Obama-appointed Watson, who sits in a Hawaiian courtroom passing judgement on the lawful decrees of the President of the United States, said that the new ban “plainly discriminates based on nationality in the manner that the 9th Circuit has found antithetical to the founding principles of this nation.”
The founding principles of this nation, eh? Don’t even.
Lawyers for the state of Hawaii argued that the new ban, which includes citizens from North Korea, Chad, and government officials from Venezuela, is nonetheless still a continuation of the president’s “promise to exclude Muslims from the United States.”
This has gone far enough and it’s time for the Supreme Court to take these cases up in full. Their reasoning behind dismissing the case – that the original ban had expired – made legal sense, but it was still a matter of plainly kicking the can down the road. Lower courts all over the country have now ruled against Trump’s travel bans, and it’s clear that Judge Watson is not the only one using extrajudicial reasoning to come to these conclusions. We need high court clarity and we need it quickly. Because what we have now is a situation of unprecedented judicial activism. It’s endangering our national security and it is eroding the very foundation of our democratic system of government.
There’s no two ways about it: The President has the authority to restrict travel from any nation if he deems it to be in the interests of our national security. It does not MATTER what he said on the campaign trail about Muslims. All that matters is what’s in the executive order itself. Get Watson and the rest of his liberal cohorts off the bench before this nation crumbles under the weight of their terrible, illegal decisions.
